Article 4 direction consultations and notifications
Article 4 directions
Legislative changes were made to the Use Classes Order in September 2020. As a result of this the former use classes listed below were combined into a new class E (business commercial and service uses).
- A1 shops
- A2 financial and professional services
- A3 restaurants and cafes
- B1 business
- Parts of D1 non residential institutions (clinics, health centres, crèches, day nurseries and day centres only)
- Parts of D2 assembly and leisure (gymnasiums or area for indoor or outdoor sports and recreations (except for motor sports, or where firearms are used)
In August 2021, changes were also made to the General Permitted Development Order 2015. This resulted in permitted development right Class MA. Class MA allows for the change of use from Use Class E (commercial, business and service) to Class C3 (residential).
Planning legislation allows us to make an Article 4 direction to remove permitted development rights (within a specified area and across the administrative area). When permitted development rights are removed in a local area, anyone wishing to carry out the described development will need to submit a planning application. Butterfield Green and Capability Green
New article 4 directions at Butterfield Green and Capability Green came into effect on 1 August 2022, in response to the above legislative changes.
The article 4 directions were made with non-immediate effect on 16 February 2022 and consultation on the making of this direction took place from 17 February 2022 and ended on 25 March 2022.
The article 4 directions were confirmed on 4 May 2022 and the public were notified from 4 May 2022 of the confirmation of this article 4 direction.
This article 4 direction came into effect on 1 August 2022

Luton town centre and surrounding areas
A new article 4 direction for the Luton town centre and surrounds came into effect on 6 October 2023, in response to the above legislative changes.
The article 4 direction was made with non-immediate effect on 5 October 2022. Consultation on the making of this direction took place from 5 October 2022 and ended on 4 November 2022
The article 4 direction was confirmed on 25 January 2023 and the public were notified of the confirmation from 25 January 2023.
The article 4 direction came into effect on 6 October 2023.
