Flood investigations

Under the Flood and Water Management Act (2010), LBC is required, on becoming aware of a flood in its area, to investigate to the extent that it considers it necessary or appropriate:

  • Which Risk Management Authorities (hereafter, RMAs) have relevant flood risk management functions and;
  • Whether those RMAs has exercised, or are proposing to exercise, those functions in response to the flood.

Where any authority carries out a formal investigation it must:

  • publish the results of its investigation and;
  • notify any relevant RMAs

The authority is not required to publish and notify if the flooding is minor and only warrants an informal investigation.

The council will give priority to investigating incidents of flooding where the flooding has affected buildings.

The above Act does not compel the LLFA to identify all the causes and parties responsible for the flooding. It only requires identifying the risk management authorities with relevant flood risk management functions.
