Taking you child out of school for term time holidays can be a contentious issue. Please consult your child’s school for further information on their term time leave policy

We have compiled this list of frequently asked questions to provide some guidance.

Have I the right to take my child on holiday in term-time when I wish?
No. Schools have the discretion to grant leave of absence, but it will not automatically be granted.

What sort of factors will influence the school’s decision?
Your child’s attendance and attainment levels, whether the trip will mean your child missing public examinations, the nature of the trip, your child’s previous attendance record and whether they have had an extended holiday during their time at School.

How will the time away be recorded?
It will be authorised absence if agreed by the school. If it is not agreed by the school, it will be recorded as unauthorised absence, and could result in a penalty notice being issued.

Can holiday leave be granted retrospectively?
No, all requests have to be made in advance.

What happens if we don’t return on the agreed date?
The absence will be unauthorised, and after a further 10 school days your child’s name will be removed from the school’s roll. Admissions and the Education Welfare Service will be informed and a fixed penalty notice may be issued.

What happens if my child is removed from the school’s roll?
You must contact the Luton Admissions Service on 01852 548016 for advice and information on enrolling your child in another school.

What if I need a longer holiday than 10 days?
You should ensure that any extra time falls within school holidays.

Is there a right of appeal against a decision to remove from the school’s roll?
No, schools are legally entitled to take this course of action.

What is the Penalty Notice fine for term time leave?
The fine is £50 per parent per child, if paid within 28 days. e.g. a family of 2 parents with 2 school aged children taking their children on unauthorised term time leave equals £200. Follow this link to find out more about penalty notice for non school attendance.
