... unless one of the 23 exemptions contained in sections 21 – 44 of the Act applies.

Some of these are “absolute” exemptions whilst others require the Council to decide whether the public interest in relying on the exemption is outweighed by the public interest in disclosing the information requested.

Some reasons why information may not be released:

  1. the information is available somewhere else (in another place, or under other legislation)
  2. the law says we must not release it
  3. we intend to publish the information in the future
  4. the information is personal information whose disclosure would breach the Data Protection Act
  5. the information is confidential
  6. releasing the information would harm: 
  • the effective conduct of public affairs
  • commercial interests or the economy
  • law enforcement and investigations
  • health, safety and the environment
  • national security and defence
