Any person who is a Disabled Persons Badge holder may apply for the provision of a parking bay under the Road Traffic Regulation Act 1984.
To apply for a parking bay the following criteria must be met:-
- the applicant's home has no opportunity to provide off street parking (for example, a front garden of sufficient depth for conversion and provision of a vehicle cross over), or there are planning objections to such off street parking
- parking demand is so severe that parking space in close proximity to the applicant's address cannot be found for the major portion of most days (for example, occasional short lived "invasions" by patrons of places of public use would not normally qualify)
- the driver is a Blue Badge Holder who is only able to walk or propel a wheelchair for short distances outside the house. The driver should be suffering from "substantial and permanent ambulatory disability (for example, absence of or defect in the lower limbs, defects in the spine or nervous system or other motor defects which result in reliance on a wheelchair; considerable difficulty in walking more than a short distance, pain or detriment to his/her condition)
- the passenger is a Blue Badge Holder and the driver is unable to park in the road or allow the disabled person out or cannot push a wheelchair from the nearest parking space which is an unreasonable distance away.
Note
- passengers will not normally qualify as it is not unreasonable to expect that an able bodied driver, providing it is safe to do so, should double park if necessary to set down the disabled passenger and remove the vehicle afterwards. Although this may entail short term obstruction of the highway, as it is not either "unnecessary" or "wilful" it is unlikely to be considered to constitute an offence
- exceptions may be made whether the passenger requires constant attendance or where the driver is of advanced age or frail and has to manhandle equipment, wheelchair etc, in addition to assisting the disabled passenger
- it is recognised that the bays are not provided for the exclusive use of the claiming Blue Badge Holder
- in the opinion of the Highway Authority and the police, the location is suitable on road safety grounds. It is generally assumed that these sites will be within an area covered by a 30mph speed limit and a system of street lighting
